Terms and Conditions

1. Parties 

We/us” means “Talking Drums Group Limited trading as Talking Drums or Talking Drums Travel and Marketplace”.

The Tour” means any tour, activity, accommodation, organised or advertised by us.

You” means the person who made the booking, who is named on the booking, and includes on whose behalf you have booked for and agreed to the below Terms and Conditions.

Supplier” means any company or person providing goods or services as part of the Travel Adventure. 

Cost” or "Pricemeans the total cost or price of the Travel Adventure.

2. Overview

These terms and conditions govern the contract between you and us to the exclusion of all other terms and conditions save for those implied by law, and no variation to these terms and conditions shall be valid unless in writing and signed by you and the company director.

3. Formation of a contract

No contract shall arise between you and us, until we have received the deposit payable and we have sent to you written confirmation (this can be in the form of an email) of our acceptance of your booking.

4. Your details

For us to confirm your Travel Adventure arrangements, you must provide all requested details at the time of booking and when requested. Necessary details include but are not limited to: full name as per passport, date of birth, nationality, passport number, passport issue and expiry date and any pre-existing medical conditions you have which may affect your ability to complete your travel arrangements. All travellers must be at least 18 years old at the time of travel.

There is no upper age limit, however some of the Travel Adventures can be physically demanding and you must ensure that you are suitably fit to allow full participation.

5. Third Party Supplier and Waiver 

Due to the nature of some of our trips, in addition to these terms and conditions, you may be required to sign and submit a separate waiver, different terms and/ or a release form to a third-party supplier who is helping to run your Travel Adventure. To the extent there are any inconsistencies between the terms of these terms and conditions and the supplemental waiver, the terms of these terms and conditions shall prevail, and supersede any supplemental waiver. We reserve the right to deny participation to you, if you have not signed a waiver.

6. Provider

Talking Drums is not a Tour Operator, but procures goods and services from third-party suppliers to conduct the Travel Adventure.

7. Acceptance of Booking and Final Payments

If we accept your booking, we will issue you with a booking confirmation email.  A contract will exist between you and us from the date we issue the confirmation. Please refer to your booking confirmation for details regarding final payments, if you have not made a full payment at the time of booking. Payment of the balance of the trip price is due 6 weeks before the tour start date. If this balance is not paid on or before the due date, we reserve the right to treat your booking as cancelled and your deposit will be forfeited.

8. Cancellation 

8a. Cancellation by you:

You may cancel your booking within a period of 14 days after the initial deposit, however the initial deposit is non-refundable. After 14 days, but before 6 weeks of the start of the tour, you may cancel your booking and receive a refund of the cost minus the non-refundable deposit,

However if you book within 6 weeks to the start of the tour, you will be required to pay the full cost, and will have 7 days to cancel. You will receive a refund of the cost minus the non-refundable deposit.

All cancellations must be made in writing in the name of the person on the booking.

8b. Cancellation by us:

If we have to cancel your trip, we will tell you as soon as possible and if there is time to do so before departure, we will offer you a full refund.

We may cancel the event or any part of it:

  • for safety reasons if we or our supplier(s) regard adverse weather conditions or other safety concerns as unacceptable and which cannot reasonably be overcome;

  • if we reasonably believe that you may cause harm or damage to our reputation or to the reputation of our suppliers or to property belonging to our suppliers;

  • if a supplier or suppliers are unable to host the Travel Adventure for any reason;

  • if changes you wish to make to the booking mean it is uneconomical or impractical to hold the Travel Adventure

9. Inclusions

The price of your Travel Adventure includes:

  • accommodation and breakfast

  • welcome and leaving dinners

  • internal flights and destination country airport transfers

  • transport to activities

  • advertised activities and tours (excluding beach/water activities).

 

All pre-booked activities and tours are based on availability and subject to change. ​​

The cost excludes international flights, food and drink (except breakfast, all meals on Safari, welcome and leaving dinners), tips and gratuities.

10. Exclusions

The price of your Travel Adventure does not include the following and you are responsible for arranging:

  • international flights, home country airport transfers 

  • taxes and excess baggage

  • food and drink, other than those specified

  • visa and passport fees

  • inoculations and medications

  • travel insurance (Please note you will not be permitted to travel on this adventure without travel insurance). 

  • tips and gratuities

  • optional activities (such as beach/water activities) and all personal expenses.

11. Privacy policy

Talking Drums must collect your personal information for the purposes of the Travel Adventure, any associated tours and activities and any products or services booked. Talking Drums collects, uses and discloses only that information reasonably required to enable it and its Third Party Suppliers to provide the particular Tour, products and/or services that you have requested  and is expressly incorporated into these Terms. By submitting any personal information to Talking Drums, you indicate your acceptance of Talking Drums Privacy Policy.

12. Acceptance of Risk
You acknowledge that the Travel Adventure and the products and services offered may involve a significant amount of risk to your health and safety. By travelling with on the Travel Adventure, you acknowledge that you have considered any potential risks to health and safety. You hereby assume responsibility for all such risks and release "us" from all claims and causes of action arising from any losses, damages or injuries or death resulting from risks inherent in travel, including adventure travel specifically, visiting foreign destinations, and participating in adventurous activities such as those included in the Travel Adventures itineraries or otherwise offered by "us" or any third party provider.

You acknowledge that the degree and nature of personal risk involved depends on the products or services booked and the location(s) in which a product or service operates, and that there may be a significant degree of personal risk involved in participating, particularly participating in physical activities, travel to remote locations, carriage by watercraft, participation in “extreme sports” or other high-risk activities, or travel to countries with developing infrastructure. Standards of hygiene, accommodation and transport in certain countries where our Travel Adventures take place are often lower than the standards you may reasonably expect in your home country or region. You agree that the Tour Operator is not responsible for providing information or guidance with respect to local customs, weather conditions, specific safety concerns, physical challenges or laws in effect in any locations where a Tour, product or service is operated. You acknowledge you have considered the potential risks, dangers and challenges and your own personal capabilities and needs, and you expressly assume the risks associated with travel under such conditions.

You must at all times strictly comply with all applicable laws and regulations of all countries and regions. Should you fail to comply with the above or commit any illegal act when on the Travel Adventure or, if in the opinion of "us" or the third party Tour Operator (acting reasonably), your behaviour is causing or is likely to cause danger, distress or material annoyance to others, "we" may terminate your travel arrangements on any product or service immediately at your expense and without any liability on "our" part. You will not be entitled to any refund for unused or missed services or costs incurred as a result of termination of your travel arrangements, including, without limitation, return travel, accommodations, meals, and incidentals.

13. Complaints

You agree to bring any complaints to Talking Drums as soon as possible in order to provide us with the opportunity to properly address such complaint. Talking Drums assumes no liability for complaints that are not properly brought to our attention and cannot resolve or attempt to resolve complaints until proper notice is provided. If you fail to notify Talking Drums of complaints or concerns while on the Travel Adventure, Talking Drums will have been deprived of the opportunity to investigate and rectify your complaint immediately and this may affect your rights under these Terms. Any complaint made after the completion of a Travel Adventure must be received in writing within 14 days of the last day of travel of the booking in question.
